Terms of Service

1. User Accounts

To use most features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

2. Service Usage and Limits

The Service is currently offered free of charge to all registered users.

• Camera Limits: Each account is limited to a maximum of five (5) active cameras. We reserve the right to modify this limit at any time to ensure fair usage of system resources.
• Fair Use: You agree not to misuse the Service or help anyone else do so. We reserve the right to suspend accounts that place an unreasonable load on our infrastructure.

3. User Content and Data

You retain full ownership of the images and any other content you upload to the Service ("User Content").

• License Grant: By uploading User Content, you grant JBroTX AI Solutions LLC a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process the User Content solely for the purpose of providing and improving the Service to you. This includes storing your images, running them through our AI models, and displaying the results to you.
• Acceptable Use: You agree not to upload any User Content that is illegal, defamatory, infringing on intellectual property rights, or otherwise harmful. We reserve the right to remove any content that violates these terms.
• Data Retention and Deletion:
  • For all users, non-retained image files (images not marked with the "Retain" flag) are subject to automatic deletion from our storage servers after they are sixty (60) days old.
  • Metadata associated with your images (including timestamps, animal detections, weather data, and other analysis results) will be retained indefinitely to allow for long-term trend analysis, even after the image files themselves are deleted.

4. Service Availability

The Service is provided "as is" and "as available." We do not guarantee that the Service will always be secure, uninterrupted, or error-free. We may perform maintenance or upgrades that could temporarily affect the availability of the Service.

5. Termination

You can terminate your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service will immediately cease. Data retention upon termination will be handled as described in Section 3.

6. Limitation of Liability

To the fullest extent permitted by law, JBroTX AI Solutions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

7. Changes to Terms

We reserve the right to modify these Terms at any time. If we make changes, we will provide notice of such changes, such as by sending an email, providing a notice through the Service, or updating the "Last Updated" date at the top of these Terms. Your continued use of the Service will confirm your acceptance of the revised Terms.
